We reserve the right to update or modify these terms and conditions at any time without prior notice. Your use of onnero.com.au following any such change constitutes your agreement to follow and be bound by the terms and conditions as changed. For this reason, we encourage you to review these terms and conditions whenever you use this website.

Australian Consumer Law

Australian consumers have certain rights under the Australian Consumer Law. These Terms and Conditions and other Onnero Policies are not intended to affect your rights under the Australian Consumer Law.

Onnero’s Role

Onnero allows third party manufacturers to list and sell their products on the onnero.com.au website. The relevant manufacturer is indicated on the respective Product page. While Onnero helps facilitate transactions that are carried out on its’ website, Onnero is neither the buyer nor the seller of the Products. Onnero provides a venue for manufacturers, producers and brands to negotiate and complete transactions. Accordingly, the contract formed at the completion of a sale for these third party products is solely between the Member and Manufacturer. Onnero is not a party to this contract nor assumes any responsibility arising out of or in connection with it nor is it the  Manufacturer’s agent (except for the limited purpose of acting as the Manufacturer’s payments collection agent). The Member satisfies their obligations to the Manufacturer when Onnero receives the sale proceeds. The Manufacturer is responsible for the sale of their products and for dealing with any Member claims or any other issue arising out of or in connection with the contract between the Member and the Manufacturer. Because Onnero wants the Member to have best and safest buying experience, Onnero provides to the Member a range of minimum Quality and operational Standards and Policies in addition to any contractual or other rights or remedies that the Member may have against the Manufacturer or any other party.

Every Manufacturer has signed up to these Standards and Polices which gives you peace of mind that no matter who you buy from or the Brand you choose, every purchase can be made with confidence that you are getting the best value from reputable, quality Manufacturers, regardless of where they are located or the country of origin of their products.

Onnero Membership

Use of your Onnero Membership is subject to these Terms and Conditions.

Members may post reviews, as long as the review is an accurate representation of their experience of the product and is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable.

Members must not post a review that contains political campaigning, commercial solicitation, chain letters, or any form of “spam”.

Members are responsible for their reviews and represent and warrant that they are truthful and accurate. You agree to indemnify Onnero for all claims brought by a third party against Onnero arising out of or in connection with your reviews except to the extent that any liability arises from Onnero’s failure to remove the review when we receive from a relevant party a valid Notice Form as described in these conditions relating to the review.

Your Member name will appear with the review. We reserve the right (but not the obligation) to remove or edit non-complying reviews.

If you post a review and unless we indicate otherwise, you grant Onnero and it’s affiliates a non-exclusive, royalty-free and fully sublicensable and transferable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such review throughout the world in any media.

Electronic Communications

When you use any Onnero Service or send emails, text messages, use our chat feature and other communications from your desktop or mobile device to us, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, such as by email, text, in-app push notices or by posting messages or communications on our website. You consent to receive communications from us electronically and agree that communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You consent to receive sales invoices electronically. Electronic invoices will be made available in pdf format in the My Account area of the website. For each delivery, we will inform you in our Dispatch Confirmation if an electronic invoice is available.

Intellectual Property

All intellectual property rights (Intellectual Property) in any content on the Website, including, but not limited to, images, pricing, artwork, its visual design, and the arrangement and display of any content on the Website (Material) is the property of Onnero or its content suppliers and is protected by Australian and international copyright and authors’ rights laws and (where applicable) database right laws.

Unless expressly authorised under these Terms and Conditions or otherwise in writing, you may not reproduce, adapt, modify, display, extract or distribute any Material or any part of any Material. You also may not use any data mining or data extraction tools, robots, systems or software, or similar data gathering and extraction tools, to extract the Material for any purpose whatsoever or disassemble, reverse engineer or otherwise attempt to discover or access any source code or other information related to the Website.

If you post any information on our Website, such as a product review, you grant to Us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute that information for any purpose we decide.

Trade Marks

Graphics, logos, page headers and service names made available through any Onnero Service are trade marks or trade dress of Onnero. Onnero’s trade marks or trade dress may not be used in conjunction with any product or service that is not Onnero’s, including but not limited to, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Onnero. All other trade marks that are not Onnero’s, such as the trade marks and other names use by manufacturers whose products appear on Onnero’s website are the property of their respective owners. You must not use any meta tags or any other hidden text using any of Onnero’s trade marks or names without our express written prior consent.

Website Use

Onnero might provide links to Manufacturers’ websites or the websites of their affiliated companies. Onnero is not responsible for examining or evaluating these websites, and we do not warrant or accept any responsibility or liability for the actions or offerings of any of the Manufacturers or the content of their websites. Onnero is not responsible for the content or privacy practices associated with linked websites and before purchasing a Product, Members should carefully review the Manufacturer’s terms and conditions and their privacy statements.

You must ensure that Your access to, or use of the Website is not illegal or prohibited by laws which apply to You.

You must take Your own precautions to ensure that Your process for accessing the Website does not expose You to risk of viruses, malicious computer code or other forms of interference which may damage Your computer system. We take no responsibility for any such damage which may arise in connection with Your use of the Website.

Privacy

We may disclose the data collected in your Order to the Manufacturer for the purposes of processing and fulfilling your order (and that your data will be subject to the privacy policy and practices of the Manufacturer); and

We may store, process, use and disclose data, other than credit card details, in order to provide you with marketing information from time to time, including regarding other Products or Onnero Services that may be of interest to You; and

Your data will be handled in accordance with Our Privacy Policy.

Disclaimer and Limitations of Liability

Onnero allows Manufacturers to list and sell their Products on the Website but Onnero is neither the buyer nor the seller of these Products. The contract formed at the completion of a sale for Products is solely between the Member and the Manufacturer. We are not a party to this contract nor does Onnero assume any responsibility arising out of or in connection with it. We provide no warranty in respect of the Products. The Manufacturer is responsible for the sale of their Products and for dealing with any claims or any other issue arising out of or in connection with the Products and the contract between a Member and the Manufacturer.

Onnero shall not assume any responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer, telecommunication equipment, or other property caused by or arising from your Membership. IN NO EVENT WILL ONNERO, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, AGENTS, SUCCESSORS, ASSIGNS, PARTNERS NOR ANY PARTY INVOLVED IN THE CREATION, PRODUCTION OR TRANSMISSION OF THIS WEBSITE BE LIABLE TO ANY PARTY FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THIS WEBSITE, ANY WEBSITES LINKED TO THIS WEBSITE, OR THE MATERIALS, INFORMATION OR SERVICES CONTAINED AT ANY OR ALL SUCH SITES, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Onnero will not be responsible for: (i) any loss arising from the unavailability of any product; (ii) losses that were not caused by any breach on our part; (iii) any business loss, loss of sales, profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure; (iv) any indirect or consequential losses, including but not limited to losses arising out of the cost of replacement, or recovery or recoupment of any investment made by you in connection with these Terms and Conditions, even if Onnero has been advised of the possibility of such costs or damages; and (v) any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

Unless otherwise stated in writing, our liability to you for any loss arising from or relating to the offer or sale of any product by us on the website is limited to a refund of the relevant amount paid for the product (including applicable shipping fees).

The disclaimers, exclusions, and any other limitations on Onnero’s liability in this Section do not override any express commitments Onnero gives to you.

Nothing in these Terms and Conditions is intended to: (i) exclude, restrict or modify any non-excludable right or remedy you have under law including the Australian Consumer Law; or (ii) limit or exclude our liability to you for losses, to the extent such loss is caused by our gross negligence or criminal conduct. Any disclaimer, exclusion, or limitation as provided for in these conditions applies to the full extent permitted by law and subject to any non-excludable right or remedy.

Products, Content and Specifications

Unless specifically stated otherwise, Onnero is not the Manufacturer of the products sold on this website. Features, content, specifications and prices of Products described or depicted on the Website are provided by the Manufacturer of the product(s) and are subject to change without notice.

All weights and dimensions of Products described in the Website are provided by the Manufacturer of the product(s) and are approximate. All screens are measured diagonally and all screen images contained on the Website are simulated unless otherwise indicated.

We make all reasonable efforts to accurately display the attributes of products made available on the website, including the applicable colours; however, the actual colour you see will depend on your computer system and we cannot guarantee that your computer will accurately display such colours. The inclusion of any products or services in this website at a particular time does not imply or warrant that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state and international laws in regard to the possession and use of any item purchased from this website. By placing an order, you represent that the products ordered will be used only in a lawful manner.

While we work to ensure that product information on our website is correct, products and any product packaging and materials may be different from that displayed on our website. All information about the products on our website is provided for information purposes only and our sole liability in the event any incorrect product information will be to accept a return of the product in accordance with our Change of Mind and Returns Policy and your statutory rights. We recommend that you do not rely solely on the information presented on our website. Please always read labels, warnings and directions provided with the product before use. In the event of any safety concerns or for any other information about a product, please carefully read the information provided with the product, contact the manufacturer, or report the concern by contacting us.

Onnero accepts no liability for inaccuracies or misstatements about products by manufacturers or other third parties. This does not affect your statutory rights.

Cancellations & Returns

Our Delivery and Returns Policy and Change of Mind Returns Policy apply in addition to other rights and remedies a Member may have under law including under the Australian Consumer Law.

Unless one of the exceptions listed below applies, a Member can cancel their order for a product for a full refund any time before we send the Shipment Confirmation relating to that Product.

You can submit your cancellation request using the Orders section of My Account.

The right of cancellation does not apply to:

1. the supply of goods made to your specifications or clearly personalized;
2. the supply of goods which may deteriorate or expire rapidly;
3. the supply via download of digital content (including but not limited to apps, digital software, digital magazines, ebooks, music, etc) which is not supplied on a tangible medium (e.g. on a CD or DVD) once download or use (whichever is earlier) has begun; and
4. the delivery of newspapers, journals or magazines with the exception of subscription contracts.

Change of Mind Returns

Members may return most new, unopened items sold and fulfilled by Onnero within 30 days of receipt of delivery for a full refund of the purchase cost of the item. For further details please see our Change of Mind Returns Policy.

Faulty or Damaged Goods

If a Member receives Products that are defective or faulty, they should first contact the Manufacturer through My Account. In the event the Manufacturer does not resolve the issue to your satisfaction within 5 business days, Members may escalate to Onnero, and Onnero will resolve the dispute in accordance with our Buyer Protection Policy and the Australian Consumer Law.

Fulfilment & Delivery

For fulfilment and delivery by Onnero, Members may select a window for delivery and Onnero will endeavour to ensure that the Products are delivered in a prompt and timely manner within the times selected by the Member. However, from time to time, it is possible that shipping and other factors outside of Our control may result in delays. Onnero does not accept any liability for loss or damage suffered by anyone as a result of any such delays.

Products must be delivered to physical addresses and will not be delivered to PO Box addresses. Unsuccessful deliveries due to an incorrect address or not collecting the item from the customer designated collection point may result in additional restocking or redelivery fees.

If a Member gives written authority for Products to be delivered without a signature, any and all included insurance cover will be voided.

Onnero reserves the right to not deliver Products to remote or rural locations.

Products delivered by the Manufacturer to Members are part of the contract between the Member and the Manufacturer. Manufacturers’ reserve the right to not deliver Products to selected locations. When an order is placed and that order is to be fulfilled and delivered by a Manufacturer, it will be subject to the Manufacturer’s terms and conditions. Onnero does not accept any liability whatsoever for orders fulfilled and delivered by a Manufacturer.

Duties and Taxes

Members are responsible for duties and taxes for deliveries to locations outside Australia. All items entering a foreign country are subject to customs inspection and assessment of the duties and taxes in accordance with that country’s national laws.

Your Account

Members are responsible for maintaining the confidentiality of their account and password information, and you agree to accept responsibility for all activities that occur under your account and password. Onnero reserves the right to refuse service, terminate Memberships, remove or edit content or cancel orders.

By placing an order, you warrant that you are over 18 years of age, and that you are providing Onnero with accurate, truthful information and that you have the authority to place the order.
